Please read these Terms & Conditions ("Terms") carefully before using the www.fpstweak.com website and the FpsTweak software services operated by FpsTweak.

1. Acceptance of Terms

2. Description of Service

FpsTweak is a PC optimization software platform designed to improve gaming and system performance. The Service includes, but is not limited to, system tweaks, performance scripts, game presets, and related features as described on our website. Features vary depending on the subscription plan selected.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account and password.
• Restricting access to your computer or device.
• All activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

• Automatic Renewal: Your Subscription will automatically renew at the end of each Billing Cycle unless you cancel it or we cancel it. You may cancel your Subscription renewal either through your online account management page or by contacting our support team.
• Fee Changes: FpsTweak, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. We will provide you with a reasonable prior notice of any change in Subscription fees.
• Refunds: Refunds are processed according to our Refund Policy.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of FpsTweak and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FpsTweak. The FpsTweak software is licensed, not sold, to you.

6. Prohibited Uses

You agree not to use the Service in any way that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Attempts to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service.
• Reverse engineers, decompiles, disassembles, or otherwise attempts to derive the source code of the software.
• Shares your account credentials or resells access to the Service to any third party.
• Uses the Service for any commercial purpose without our prior written consent.
• Violates any applicable local, state, national, or international law or regulation.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

FpsTweak does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. The results of any PC optimization are not guaranteed, as system performance can vary based on individual hardware and software configurations.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FPSTWEAK, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM THE USE OF OR INABILITY TO USE THE SERVICE.

You acknowledge and agree that using PC optimization software carries inherent risks. You are solely responsible for backing up your data and system settings before using our Service. FpsTweak shall not be liable for any damage to your computer system or loss of data.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or cancel your subscription through your account settings.

10. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
